Comedy of---------

When somebody makes an attempt to influence an honest judge, he has three options:

1. Refuse to hear the case

2. Consider the matter; and if on merits it deserves to be decided in favour of the person who tried to influence, transfer the case. But if on merit, matter has to be decided against the person, decide.

3. Expose the person; don't hear the matter but initiate contempt proceedings.

I know from my own experience and experience of my friends that usually the first option is exercised by most of the judges. It is because somehow, judges believe that power of contempt should be exercised sparingly. However, it is debatable.

This difficulty is suffered usually by new judges because after sometime at the bench, people know whether a judge is approachable or not.

In my view, justice Raghupati was wrong to publicly disclose only a part of information. Either he should have kept mum and decided the matter on merits, or he should have recused himself without disclosing reasons. When he disclosed that he was being approached, he should have initiated contempt proceedings. I do not understand why did he write a letter to chief justice of Madras. After all, it was not an administrative matter.
But once a letter had been received by chief justice why did he forward it to chief justice of India. Prima-facie a matter of contempt had been brought to his notice.

Chief justice of Madras high court had ample powers to initiate contempt proceedings.
In my view, the chief justice of india could have not proceeded in the matter. But why did he say that Raghupati had not mentioned the name of any minister, when actually he had mentioned rajas name.
Lot of explaining has to be done by many.

Tale of two cities

As a consequence to making children's education a fundamental right parliament enacted an Act and created a commission known as national commission of protection of child rights.
The commission recently convened a public hearing at Chennai to listen to grievances of people.I was invited to be a member of jury.Hundreds of complaints were heard and redressed.
Some time back tamil nadu govt had fixed fee for students of private schools.Against this decision teachers of thirty thousand schools had gone on strike for two days.the parents of students of these schools complained against teachers and management.they wanted compensation.I was surprised to see dozens of people arguing vehemently against teachers who went on two days strike against the interest of students. Besides seeking monetary compensation these people also wanted teachers to teach their children on holidays.
In Srinagar teachers did not teach their students for six months and nobody complained.

perverse judgment

A judgment by a court of law includes identification of points of contentions between the litigants and adjudication of such issues in accordance with law. Unfortunately, both these tasks have not been performed by three learned judges of Allahabad high court while disposing of the sixty year old Ayodhya dispute suit. The issues which had been framed have not been decided and the issues which were not even framed have been decided.
Lord ram is bhagwan is a matter of faith and can neither be proved nor disproved in a court of law. But lord Ram was born at a particular place is surely a question of fact.
The judges have have not taken into consideration the law of evidence applicable to courts in India. In fact, it is a judgement not based on rule of law. If this judgment is not set aside, it will create a precedent which can have dangerous consequences for the country.

Even if every citizen of India accepts the partition of suit property as decreed by court, even then this judgment should be challenged. The solution decreed by court can be a solution by compromise and if it is done I will have no objection as a student of law, but if the decree is accepted it will be a tragedy as far as civil law is concerned.
I have briefly tried to mention my reservations about the judgment. I have read almost ten thousand pages to write a paper for a seminar. If any student of law has any inputs he may send those so that the paper is as comprehensive as possible.

story completed.

On Aug 30 i wrote a blog "an incomplete story".i had requested friends to complete the story,though a few friends responded yet i feel i should spell out what is in my mind.Since it is pure fiction anybody and everybody can use his imagination.
IN a family everybody except a deaf and dumb child died of cholera.this child was fighting for his life all alone in a dilapidated hut.He grew week and very week and started to believe that end was about to come.He was feeling very thirsty,at this point he talked to himself,"after all i have to die why not after having a glass of water".He took a glass of water and only after a few minutes he was feeling better.He took water and more water,he realised he was recovering,he took a loaf of bread.he went into deep sleep and when he woke up he found himself quite healthy.He came out of his house shouting showing by gestures that he had defeated cholera and he could cure any body.By his gestures he directed people to take plenty of water.By this time hakeem sahib was himself fighting the disease,villagers were indebted to him for the services he had rendered to village for years,therefore villagers immediately took hiim to hakeem sahib.young boy took charge of the situation and in a few days hakeem sb got well.During this period the boy came close to hakeem sb.
Hakeem sb loved the boy, since the boy was deaf and dumb every body could not converse with him,Hakeem sb was intelligent he quickly picked up the sign language and the Boy always felt comfortable in the company of hakeem sahib.People however,had lost faith in hakims professional ability,in cases of ailments they would only consult the young boy.Though the boy was blessed he had communication problem.There fore in public interest an agreement came into being with consent of elders.Henceforth patients would be treated by the team of young boy and hakeem sahib.
The patient would communicate about his problems with hakeem sb who in turn would take advice from the young boy and then write prescription and also communicate instructions given by young boy through gestures.The arrangement worked wonders and the people lived happy thereafter.

'no matter which way you go,you can not fail to get home

ALpha,was a name more more respected and popular then any other name in 1965.A college student from sopore was leading a students agitation.He was elusive,yet omnipresent.There was romanticism and heroism associated with this name and youngsters believed ALpha would lead them to their destination.Alas,he went into oblivion.He could not achieve the goals he had set for himself,and died three days before in a hospital after a brief illness leaving behind his wife three daughters and o son.
Syed mohamad ilyas belonged to sopore;s very well respected peerzada family,the bukharies.
His father syed Ammanullah bukhari was awell respected person of sopore.
I came into contact with Ilyas in 1971,at Aligarh muslim univrsity.Both of us joined Aligarh for pursuing lawin 1971. We were class mates and as a matter of fact room mates also.Though his room was in sir syed hall but after we became friends ilyas would seldom go there,instead he would stay with us in Sulaiman hall.I was not the only attraction in Sulaiman hall,the biggest attraction in Sulaiman hall was mr showkat jan.Persons who know showkat will agree with me
that he is a magnet,either attracts forcefully or repels forcefully.
Ilyas must have died a satisfied man,not that he achieved anything in life,but for the fact that he never compromised on his convictions.Though i seldom agreed with him yet i
respected him because he was not a hypocrite.
Mr Ali mohd jinah was the only hero,Pakistan was the only dream.This was the bottom line in any discussions with him.
ILyas was very well read and intelligent.he had interest in diverse fields,Science,law literature English and Urdu,sports and of course politics.
He passed msc[ pre] in botany,went to jail.after release did not pursue msc,took admission for ma[eng] completed previos went again to jail.
After release took a job as med rep left it after some time and got appointment as a science teacher.He once told me he was posted at Nadim memorial higher secondary school at bandipore where one of his students was mr Khazir mohd wani,who is presently a meber of PSC.
Ultimately he landed at ALigarh where Mr Khazar mohd was also his class fellow.
He was so intelligent &sharp. For studying a six months course he needed a few hours and that also with out any help.I have many anectodes to say but this is not the occasion.

An incomplete story

Once upon a time there was a Hakeem sahib in a village. Anybody in the village and in adjacent villages having any ailment would knock at the door of hakeem sb. He would treat hundreds of patients everyday.
He had a novel method of treating his patients; he believed that before patient is treated and given medicine his body should get cleansed. He advised his patients not to take food or water. This process would continue till the patient stopped passing of urine and stool. That was the indication that body is cleansed and herbs would respond.
Everything was going well for hakeem and his patients till there was outbreak of cholera. Hakeem sb asked his patients to stop eating food and drinking water. There were deaths everywhere, hakeem sb did not know what to do?
Friends, this is an incomplete story. I have an end in mind, but I want my friends to suggest an end.

WISE MAn

Once upon a time there was a wise man in a village.The innocent and illiterate villagers would always seek advice of this man in each and every matter.This man would advice,counsel educate and solve the problems of villagers.He would even treat patents.
On a day a villager found an object in forest which he had never seen before,he took it and asked his friends about the object,on their showing ignorance they decided to go to WISE MAN.
The wise man on seeing the object remained silent for a while,then started weeping, and after a while started laughing.One of the persons asked him ,sir.before you tell us about the object,please tell us why did you weep and why did you laugh.the WISE MAN replied,'I was thinking who will solve your problems after i die,therefore i wept,i my self do not know what is this object therefore i laughed.

give a title

Sixty people died in police firing in last two months.why and how?nobody is prepared to answer this question.This question as a matter of fact can not be answered by any body,because in a civilised society such incidents seldom take place,and if they take place the answers are provided by institutions and unfortunately there is none in Kashmir.
No body even in any other state would believe that high court is non functional for two months.Judges of high court are not powerless to make judicial system work even in adverse conditions.Bar is on strike,press is subjective and biased,legislators are hiding,Non governmental organisations are in hibernation.the existence of govt is discernible by seeing police everywhere and paying salaries to its employees without doing any work for those for whose service they are appointed.
Even in a state like Gujarat a home minister is behind bars for allegedly being a party to murder of an alleged offender.This has become possible because systems are in place,even a chief minister as powerful as Modi could not save his home minister.Innocent Children get killed everyday in streets of Kashmir and one has no place to even complain.

By throwing a shoe mr jan has become a hero in no time.watch face book or the crowds outside outside Jan's house at ajas bandipore.His act may be manifestation of anger of people towards India or manifestation of hatred for Mr om er abdullah,or manifestation of both.
But the response of the people to act of jan also makes it abundantly clear that there is a vacuum somewhere.
Who knows jan may be Master Abdullah of thirtees.

After along time am back,reason curfew and hartal,could not get charger of my laptop repaired.
People of our generation had the privilege of listening to discourses on Islam by greats like Ahmed deedat and DR israr.Though they are not with us yet we have the benefit of listening to their great speeches.we are fortunate to have some good scholars with us even now.
There is anew crop of so called scholars whom one can see on dozens of channels particularly on local channels.These gentlemen cant bring any body near Islam,but there is a danger they may take people away from Islam,even those who are committed Muslims.
one wonders should anybody and everybody be allowed to speak on Islam.if a person can not be allowed to practice medicine,unless he is qualified to do so ,how can a person be allowed to go on lecturing on Islam.there should be a mechanism to isolate these people. that would be in the interest of people, Islam, and genuine scholars.

Again a tragedy ,two boys killed in police firing at sopore.Unfortunately this tragedy is followed by a cruel joke.A judge who heads the state human rights commission is asked to head a commission of enquiry to identify the guilty.Had this man done his job as chief of human rights commission incidents like sopore would not have occured

The tragedy of the state is that no systems are in place. institutions which are independent in rest of the country have become sub servient to the executive in this state.

Human rights commission has been created to protect the human rights and fix the responsibilities if rights are violated, but our human rights chief needs a special commission to do what he is supposed to do otherwise.Any body can guess the outcome of such an enquiry.

Fruit juice,dry fruit,kehwa,kandi kulcha,black forest,thirty course wazwan,curd,coca cola and ice cream is what is being eaten by us in one go.So many incompatibles but we have the capability to digest all don't even know who likes what out of these delicacies but every one eats everything.The taste of dishes gets mixed up and at the end it is tasteless.Nor one is in a position to say which dish he liked the most.
unfortunately this attitude of ours is reflected in our other systems of life also.would
any body like to comment before i try to elaborate in my next post.

Startled

A whole generation of Kashmir's don't speak kashmiri.I was startled to observe that children born in last twenty years are not even able to speak kashmiri.On the other hand children born of kashmiri parents outside kashmir in these years not only speak kashmiri but take pride in speaking kashmiri. Some of these kashmiris have not even seen kashmir. The local boys and girls feel ashamed to speak kashmiri.Where are we going?Can our experts explain this phenomena and tell us what fallout it can have?

Think Before...

A number of farmers committed suicide in Andhra Pradesh during the tenure of Mr. Chandra Babu Naidu as the Chief Minister.

When Late Mr Rajashekhar Reddy came to power, he came out with a policy of paying ex gratia compensation to the family members of all those farmers who committed suicide.

To everyone's shock and horror, the incidents of suicides increased after the said policy was announced. Extreme Poverty and want drove the farmers to take such drastic steps. There was more monetary incentive in dying rather than surviving and seeing ones family members starve.

The Government of Kashmir has proposed to come out with a rehabilitation policy for stone pelters. I do hope that the Governments decision is based on expert advise and that the Policy does not create more problems than it aims to resolve.

In my opinion though, a better option would be to identify the root causes of the problem and seek to address them instead.

Had you been alive, you would have been 100 today. I know you could have lived much longer had you so desired. However, you chose to die and died 12 years ago. You wanted to face the thrill of death and you faced it when you wanted to. You died on your own terms.

How are you enjoying the hereafter and the company of Saadi and Jaami, Rumi and Iqbal, Sheikh Noor Din and now, Hassan Sofi?

You did tell me that they have put you up on the fourth floor of a multi story building. You complained of not being able to read news papers. Do you get them now? Do they still interest you? How is Mom? I know she must be in permanent attendance.

I do not miss you because I know you are always around-guiding, cajoling. However, I do wish that you communicate. It has been a while since I heard from you.

Rule of Men/Rule of Law

Birdi has been arrested and booked under Section 302 of the R.P C along with others for committing murder of Zahid, an innocent boy. Scores of killings of innocent persons were allegedly committed by Security Forces in the last two decades in Jammu & Kashmir. It is generally perceived that these cases were not even investigated.

I think Zahids case is only the second case where investigation took place. The first being that of Mr. Jaleel Andrabi. Though that case was investigated because of the intervention by the High Court, yet the accused was not brought by the Government before the Court to face trial.. Zahid's case thus assumes significance in view of the fact that the Chief Minister was not only able to register a case against a high ranking official, but was also able to place him before the law.

Birdi may or may not be guilty. However, it appears that there is prima facie evidence against him. It is the cardinal principle of law that if there is prima facie evidence against a person, he must face trial. None of the Chief Ministers have been able to pursue this Principle so far.

Omar therefore needs to be congratulated and his efforts lauded by one and all. Mr Abdullah should however remember that the bringing the accused to law should not not depend on a Mufti or an Abdullah but on the system. Action must not depend upon a person but on a system established under law.A Chief Minister should not be driven to force the Central Government to take Action every time such an unfortunate incident takes place . The action must be inherent in the system.

Omar is well advised to devise a mechanism where all, who are prima facie guilty are brought before the courts. I wish the persons who man the system remember that what is expected of them is that they will ensure that the system functions in accordance with the Rule of law. We are governed not by men but by the Rule of Law.

We are better placed in terms of economy. We have conquered recession. We are better placed than USA ,China and the rest. We are an atomic power. We produce the highest number of scientists, doctors and engineers in the world. We have been maintaining a growth rate of more then 7%. An industrialist constructs a house for 35 thousand crores. A film does a business of one thousand crores.
sixty five people die in the hope of getting Rupees twenty.
Are we really progressing or creating conditions to graduate from functional democracy to anarchy.

Divine punishments given to groups of people include hunger, scare, earthquakes, floods and also stoning. Unfortunately we are recipients of all types of such divine punishments for decades now. Is it not time to start thinking afresh and do some introspection before it is too late.

Some time back my brother Afadul had started a debate on stone throwing when he was SSP srinagar. I would request him to throw some light on my observations.

From the year 1982, the state of J&K has been trying to enact a law that would entitle such citizens of Kashmir to come back from( Azad)POK who had migrated after1947. A Bill was passed by state legislature but was not assented to by the governor who reserved it for consent of the President. The president in turn referred it to The Supreme Court and the Supreme Court sent the reference back with out an answer.The basis for such law is that POK is a part of J&K and as such citizens of that part of Kashmir are citizens of India.They therefore have a right to return and even settle in any part of India.

This position has now been conceded by home minister .The resettlement bill should therefore receive the consent of the Governor.

It is being said that in killing of Zahid not only Lakhvindar is responsible but some officers of BSF are also involved.Now that the case is being investigated by state police,it is their job to bring guilty to law.The C.M has already taken credit for getting custody of lakhvindar and the case has become a test case for him also.More then the accused in this case The C.M himself is on trial.

Why not Autar?

A police constable of B.S.F has been apprehended and handed over to Kashmir police in connection with the murder of Zahid Farooq. The Chief Minister deserves to be congratulated as it is no mean achievement in the context of Kashmir. Jaleel Andrabi's Killer, Major Autar Singh was identified by the police in 1997 and evidence was also collected in the same year. He is still at large.

Since the Chief Minister has been able to get hold of Lakhvinder, and if during investigation it is found that he is responsible for the murder, the trial must start immediately.

I suggest constitution of a special court so that the accused is tried on a day to day basis and the Trial is completed expeditiously.

The Government must also appoint a competent lawyer as a special Public Prescutor. He should be appointed on merit and not on his political background. I would also urge the Kashmir Bar association not to do anything which will be an impediment to fair trial or which may be responsible for transfer of the Trial outside Kashmir.

The accused should be given all legal assistance and he should be able to appoint a counsel of his choice. The work of the counsel should be facilitated by the bar association.

I hope this is a new beginning and all culprits will be brought to book. The Chief minister may also use his good offices to get Autar Singh to face Trial in respect of Murder of Jaleel

The support SRK is receiving in his fight against CHACHA,BHATIJA is unprecedented. No body in recent times has been able to get so much of support against shiva sena.Credit must be given to SRK,he is perhaps the first one who has defied CHACHA.
So far so good, lets hope SRK sticks to his stand,if he does it will be CHACHAS last battle.

A coward


We belong to same generation; he may however be senior to me by about five years.I followed his life and career as millions like me also did. The tallest in film industry, a great actor a hero an icon for millions.
A hero on celluloid and a hero in real life, fought for his life after a serious accident maintains his youth even with serious ailments, faced with courage and dignity the bankruptcy of a company he floated.
However when Bhatija threatened him, he prostrated within twenty four hours, although he had committed no wrong. With out a reason he writes pages in praise of Chacha. He becomes brand ambassador for Gujrat's Modi. Is it sheer cowardice or pure business? In any case it is not heroic!

Chacha Bhatija.

In Pakistan, we have good Talibans and bad Talibans. In India, we have good Khans and the bad ones. At least, that is what Chahcha Bhatija want us to believe. M/S Yusuf Khan, Shahrukh Khan, Amir Khan,Salman Khan and Saif Khan are stars and actors in their own right. All of them are successful and are therefore Bad Khans. Every now and then, you can see a morcha against one/some/all of them. On the other hand, you have Fardeen Khan and his cousin, Zaid Khan, who are not so successful. They are therefore good Khans. Both chacha and Bhatija want to outsmart each other in taking any opportunity to mallign and harass the bad Khans.

Whether RTI should apply to seek information relating to appointment of judges or not is being debated in and out of courts presently.One of the the former chief justices of supreme court is reported to have opposed the idea.Mr justice Rajinderbabu has said that once he had sought opinion of one of his brother judges in supreme court about suitability of a person for appointment as a supreme court judge and he was told if he wanted opinion in writing he would support but orally he would oppose.Iam not surprised I only wonder whether we deserve such spineless judges .If a judge of supreme Court cant give an honest opinion about a candidate can any body have any doubts about the integrity of the judge concerned?

Pre- Islamic period of Arabia is known as (DAUR_JAHILIYAT) One of the reasons for that is that Arabs were killing female child on birth. We are killing our female children even before birth.All children have right to live and killing of a child for its sex is barbaric and people who indulge in such practice be a doctor or a parent has no right to live.There is a controversy about an advertisement issued by govt of India which suggested hero's like Kapil Dev could not have even taken birth if his mother had not been allowed to live. This advt generated some heat because with our hero's photographs a photograph of pak general was also published.I have my own reasons to demand an apology from govt and the reason is that we don't want to protect our daughter only because she may give birth in future a hero but we protect them because we claim to be human beings and because we have no right to deprive any body of her life. the line of thinking in advt is dangerous that daughters should not be killed because in future such daughter may give birth to a future hero such daughters can also give birth to villains like Hitler and BIN-LADIN.

Yet again a judge is in news.An old friend and colleague Mr justice R.C GANDHI retired on 21-01-10 and on the same day there was a demonstration against him ,All sorts of allegations were levelled against him.He was on bench on Rajasthan HIgh court for more then three years why all these allegations were not made earlier.Don't know whether allegations are true or false but am really surprised about the fact that allegations are made only after Gandhi retired

Army chief has become deaf.I as a layman don't think it should effect him professionally. if i remember correctly we had a serving general who had lost a leg in war. IN any case generals are not supposed to listen but i know of persons who are paid to listen but are completely deaf i mean judges many judges don't hear what is being argued before them.Unfortunately they are not put to fitness tests although some of them continue to discharge judicial functions up to the age of seventy

The vice president has appointed a committee to enquire into the allegations against Justice Dinakaran. Nobody can predict when will this committee complete its task. Earlier experience is not encouraging. Committee appointed to enquire charges against Justice Mukerjee has not done anything for two years now Meanwhile Dinakaran is enjoying the office of Chief Justice of an important High court It is very important that a judge should be honest;Itis equally important that people at large should also believe that a particular Judge is honest.If judge is honest but somehow people believe otherwise(which is a rare possibility) the man is unfortunate .However in both situations the Judge must quit.IN first case because he is dishonest and in second case because he has a bad reputation People who are interested in high standards in judiciary must appeal Dinakaran and many others who have earned bad reputation to quit and spare the institution.

JUGNU On my recent visit to Srinagar .Noticed it was impossible to walk as pave ments and foot paths have completely been taken over by pavement dwellers. these people sell every thing from a fur shoe to an electric bulb. No surprise every thing is MADE IN CHINA. What attracted me most was a magic lamp.It is an electric lamp and can be used as any other electric lamp .what makes it special is its quality to illuminate when electric supply is off .Cost of this magic lamp is RUPEES 150 only. This Chinese lamp has done to Kashmir what Indian State could not do for Sixty Three years . I My self invested in three lamps during my one week stay in Srinagar and enjoyed uninterrupted light CAnt govt of india even think of producing such lamps in india

Recently, when there was news that highway between Jammu and Srinagar was closed due to heavy snow fall, a friend in Delhi told me Thank god you have a rail connection now .The valley would not be cut off from the rest of the country.I was surprised to hear this and told him that there was no rail connection between Jammu and Srinagar yet but he was adamant that it had been inaugurated by the P.M. How ignorant people of this country are about J&K. The P.M inaugurated a stretch within the valley which at best can be described as a toy for a crying baby.
A judge of the Karnataka High court has become famous for his blog .His views are extensively published. I have never read a report in press about any of his judgments.Dear bother, concentrate on judgments.
Media is taking over the function of dispensation of justice. Certainly not a good omen for democracy and rule of law. Surprisingly, every body who is some body in India appears to be appreciating it . If judiciary's role is compromised, dictatorship would not be far away.I don't suggest that the judiciary does not need reform, but it can not be at the cost of judiciary itself.
